Terms of Service

1. About Stitch

Stitch ("Stitch," "we," "us," or "our") is a private messaging platform that lets you communicate with people through text messages, voice notes, photos, videos, GIFs, file transfers, voice calls, video calls, stories, and group chats. Stitch is operated by Stitch Messaging and is available through supported web and mobile clients. By creating an account or using Stitch in any way, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must stop using Stitch immediately. These Terms apply to all users of the Stitch platform globally, including visitors, registered users, and any other person who accesses or uses our services in any capacity. We encourage you to read them carefully before using the platform.

2. Eligibility

You must be at least 13 years old to create a Stitch account. If you are under 18, you confirm that you have your parent's or legal guardian's permission to use Stitch and that they have reviewed and agreed to these Terms on your behalf. By registering, you confirm that: • All information you provide during registration and account use is accurate and truthful • You are not prohibited from using Stitch under any applicable law in your jurisdiction • You have not previously been suspended or permanently removed from Stitch for violating our Terms or Community Guidelines • You are creating the account for personal, non-commercial use unless otherwise agreed with us in writing We reserve the right to refuse service to any person at our sole discretion, including where we have reason to believe the above representations are untrue.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials — including your email address, password, and any verification codes — and for all activity that occurs under your account. You agree to notify us immediately at support@stitchmessaging.com if you suspect any unauthorized access to your account or any other security breach. Usernames must be unique across the platform and may not impersonate another person, public figure, brand, or entity. We reserve the right to reclaim usernames that violate these Terms, that are misleading, or that have been inactive for an extended period without active use. You may not sell, rent, transfer, or share access to your account with any other person or entity. Each Stitch account is intended for use by a single individual only. Creating multiple accounts to evade bans or restrictions is prohibited. You are responsible for keeping your registered email address current and accurate. We rely on your email to deliver account verification, password reset links, and important account communications. For email-and-password accounts, you must verify your email address before completing profile setup or accessing core Stitch features.

4. Acceptable Use

You agree to use Stitch only for lawful purposes and in a manner that does not infringe the rights of others or expose Stitch or its users to harm. You must not use Stitch to: • Send, share, store, or distribute content that is illegal, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable under applicable law • Harass, bully, intimidate, stalk, or cause emotional or physical harm to any individual • Impersonate any person, entity, brand, or public figure, or misrepresent your identity or affiliation • Distribute unsolicited bulk messages, spam, chain messages, or automated communications • Share or distribute malware, viruses, ransomware, spyware, or any harmful or malicious code • Attempt to gain unauthorized access to Stitch's systems, servers, databases, or other users' accounts • Scrape, crawl, harvest, or otherwise automatically collect data from Stitch without express written permission from Stitch Messaging • Use Stitch to facilitate illegal transactions of any kind, including but not limited to drug sales, weapons trafficking, financial fraud, or money laundering • Share, solicit, or distribute content that sexually exploits, endangers, or depicts minors in any form — this is a zero-tolerance violation that will result in immediate account termination and mandatory reporting to law enforcement • Engage in any coordinated activity designed to disrupt, degrade, overwhelm, or interfere with Stitch's services, servers, or infrastructure Violation of these rules may result in immediate suspension or permanent termination of your account without warning. In serious cases, we will refer your account and associated information to appropriate law enforcement authorities.

5. Your Content

You retain ownership of content you create, send, and store through Stitch, including messages, photos, videos, voice notes, stories, and files. By using Stitch, you grant us a limited license to process, store, transmit, display, and otherwise handle that content solely to operate, provide, secure, improve, and enforce Stitch. We do not sell your content. Stitch currently uses standard encryption, not end-to-end encryption. Messages, media, and call signaling are protected in transit and at rest, but authorized Stitch systems and personnel may access stored content for limited operational, support, debugging, safety, abuse investigation, report review, and legal compliance purposes. If you use the in-app Report feature, you authorize Stitch to receive and review the limited report evidence submitted from your device. That evidence may include your report reason, account and conversation identifiers, timestamps, message IDs, message types, media/file metadata, and normally the last 5 recent messages from the reported user in that chat. Disappearing messages are a privacy and storage feature, not a guarantee that content cannot be copied or preserved. Recipients may screenshot, copy, forward, download, screen-record, back up, or report content before it disappears. You remain responsible for content you send.

6. Standard Encryption & Security

Stitch uses standard encryption to protect data in transit and at rest. Data sent between your device and Stitch services is protected using HTTPS/TLS where applicable, and stored content is protected by encryption at rest provided by our infrastructure and storage providers. Stitch is not currently end-to-end encrypted. You should not rely on Stitch as an end-to-end encrypted service. Authorized Stitch systems and personnel may access stored content for the limited purposes described in these Terms and the Privacy Policy, including operating the service, debugging, abuse investigation, report review, and legal compliance. No system is perfectly secure. You use Stitch at your own risk and are responsible for maintaining the security of your own device, account credentials, operating system, browser, and network.

7. Privacy

Your use of Stitch is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains in detail what information we collect when you use Stitch, how and why we use it, who we share it with, how long we retain it, and the rights you have regarding your personal data. By using Stitch, you consent to the data collection and processing practices described in our Privacy Policy. We encourage you to read the Privacy Policy carefully before using the platform. We do not sell your personal data to third parties for any purpose. We do not use the content of your private messages for advertising, profiling, or any purpose other than delivering those messages to the intended recipients.

8. Calls & Emergency Services

Stitch provides internet-based voice and video calling features. These calls are not traditional telephone calls and cannot be used to contact emergency services. CALL AVAILABILITY One-on-one calls are available on supported web and mobile clients. Group calls are available on supported clients where the feature is implemented. Call quality and availability can vary by device, browser, app version, permissions, battery/background settings, and network conditions. STANDARD CALL SECURITY Calls use standard real-time transport security, including WebRTC/LiveKit transport protections such as TLS and DTLS-SRTP where applicable. Stitch does not record or store call audio or video, but live call media may be processed transiently by media infrastructure to connect participants. CALL HISTORY Call metadata such as call type, time, duration, participants, and outcome may appear in the Calls tab on supported clients. EMERGENCY SERVICES STITCH CANNOT BE USED TO CONTACT EMERGENCY SERVICES. You cannot use Stitch to dial 911, 999, 112, or any other emergency number. Always use a traditional phone or mobile carrier for emergency calls.

9. Suspension & Termination

We reserve the right to suspend or permanently terminate your account at any time, with or without prior notice, if we determine in our reasonable judgment that you have: • Violated any provision of these Terms of Service • Violated our Community Guidelines • Engaged in activity that poses a legal, regulatory, security, or reputational risk to Stitch Messaging or its users • Provided materially false, misleading, or inaccurate information during registration or in communications with us • Attempted to circumvent enforcement actions, such as creating new accounts after a ban You may voluntarily delete your account at any time through Settings → Deactivate Account. Upon account deletion, your messages and personal data will be removed from our servers in accordance with our Privacy Policy and applicable data retention obligations. If your account is terminated by us for violating these Terms, you are prohibited from creating a new account without our express written permission. Stitch reserves the right to identify and terminate accounts created in violation of this rule.

10. Intellectual Property

Stitch and all related logos, brand marks, designs, text, graphics, user interface elements, software, source code, and other materials are the intellectual property of Stitch Messaging and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws worldwide. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use Stitch solely for your own personal, non-commercial purposes as permitted by these Terms. This license does not include any right to sublicense, resell, or otherwise exploit the platform or its underlying technology. You may not copy, modify, adapt, distribute, publish, sell, sublicense, reverse engineer, decompile, disassemble, or create derivative works from any part of Stitch's software, design, or intellectual property without our express prior written consent. If you believe that any content on Stitch infringes your intellectual property rights, please contact us at support@stitchmessaging.com with the subject line "IP Complaint" and provide sufficient information for us to investigate your claim.

11. Disclaimer of Warranties

STITCH IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. We do not guarantee or warrant that: • Stitch will be available at all times or will be free from service interruptions, outages, or delays • Messages will be delivered instantaneously or at any specific time • The platform will be completely free from security vulnerabilities, bugs, or errors • Any specific feature will remain available indefinitely Your use of Stitch is entirely at your own risk. This disclaimer applies to the fullest extent permitted by applicable law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STITCH MESSAGING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, STITCH, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR HARM TO REPUTATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF STITCH EXCEED THE GREATER OF $100 USD OR THE TOTAL AMOUNT YOU HAVE PAID TO STITCH (IF ANY) IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, FRAUD, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE WHERE SUCH LIABILITY CANNOT BE LIMITED BY LAW.

13. Changes to These Terms

We may revise and update these Terms from time to time to reflect changes in our services, applicable legal requirements, business practices, or other legitimate reasons. When we make changes that we consider material — meaning changes that meaningfully affect your rights or our obligations — we will notify you through the app, via your registered email address, or both, with reasonable advance notice before the changes take effect. Your continued use of Stitch following notification of updated Terms constitutes your acceptance of those updated Terms. If you do not agree with any changes to the Terms, your sole remedy is to stop using Stitch and delete your account. The "Last Updated" date displayed at the top of this page reflects when these Terms were most recently revised. We recommend reviewing these Terms periodically to stay informed of any changes.

14. Geographic Restrictions & Sanctions

Stitch is not available in all regions worldwide. In compliance with United States export control laws, Office of Foreign Assets Control (OFAC) regulations, and applicable international sanctions programs, Stitch services are not available to users located in, or ordinarily resident in, the following countries or territories: • North Korea (Democratic People's Republic of Korea) • Iran (Islamic Republic of Iran) • Syria (Syrian Arab Republic) • Cuba • Crimea, Donetsk, and Luhansk regions of Ukraine • Any other country, territory, or region subject to comprehensive U.S. economic sanctions or embargo at the time of access By registering for and using Stitch, you affirmatively represent and warrant that you are not located in, ordinarily resident in, a national or resident of, or acting on behalf of any government, state-owned enterprise, entity, or individual in any comprehensively sanctioned country or territory listed above. You also agree not to disguise your geographic location through the use of VPNs, proxy servers, IP masking tools, or any other technical or legal means to circumvent these geographic restrictions. Stitch reserves the right to block or immediately suspend access from any sanctioned region at any time, without prior notice, as required by applicable law or as sanctions programs are amended. We may update this restricted regions list at any time and without advance notice as international sanctions programs change. If you access or use Stitch in violation of these geographic restrictions, your account will be immediately terminated and your account information and activity may be reported to appropriate government authorities as required by law.

15. United States Users

If you are located in the United States, the following additional provisions apply and are incorporated into these Terms: DISPUTE RESOLUTION & BINDING ARBITRATION You and Stitch agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Stitch ("Dispute") shall be resolved through binding individual arbitration administered under the rules of a recognised arbitration body, except as expressly set forth below. By agreeing to arbitration, you waive your right to a jury trial and your right to participate in any class-action lawsuit or class-wide arbitration proceeding. Before initiating arbitration, you agree to first contact us in writing at support@stitchmessaging.com with a description of the dispute and the relief you are seeking. We will make a good-faith effort to resolve the dispute informally within 30 days of receiving your written notice. EXCEPTIONS: Either party may bring an individual claim in a court of competent small claims jurisdiction. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. OPT-OUT RIGHT: You may opt out of this arbitration agreement within 30 days of first creating a Stitch account or first using Stitch by emailing support@stitchmessaging.com with the subject line "Arbitration Opt-Out," including your full name, Stitch username, and a clear statement of your intent to opt out. Opting out does not affect any other provision of these Terms. NO CLASS ACTIONS: You may only bring claims against Stitch in your individual capacity. You may not bring claims as a plaintiff or class member in any purported class, collective, or representative proceeding. CALIFORNIA RESIDENTS If you are a California resident, the following additional rights apply to you under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA): • Right to Know: You may request a copy of the specific personal information Stitch has collected about you and how it has been used or shared over the past 12 months. • Right to Delete: You may request deletion of personal information we have collected from you, subject to certain limited legal exceptions. • Right to Correct: You may request correction of inaccurate personal information we hold about you. • Right to Opt-Out of Sale: Stitch does not sell your personal information to third parties. If this ever changes, California residents will be provided with a clear "Do Not Sell My Personal Information" mechanism before any sale occurs. • Right to Limit Use of Sensitive Information: You may request that Stitch restrict its use of sensitive personal information to only those purposes strictly necessary to provide the service. • Right to Non-Discrimination: Stitch will not discriminate against you — including by denying service, charging different prices, or providing a different quality of service — for exercising any of your CCPA rights. To exercise any of these rights, contact us at support@stitchmessaging.com with the subject line "CCPA Privacy Request" and include your registered email or username for verification.

16. Canadian Users

If you are located in Canada, the following provisions supplement and, where applicable, take precedence over other provisions of these Terms: Your use of Stitch is subject to Canada's federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, including Quebec's Law 25 (An Act to modernize legislative provisions as regards the protection of personal information). CONSENT By creating a Stitch account, you provide meaningful consent to Stitch collecting, using, and disclosing your personal information as described in our Privacy Policy for the purposes of providing and improving the Stitch messaging service. You may withdraw your consent at any time, subject to legal and contractual limitations that may affect your ability to continue using certain features of the platform. YOUR RIGHTS UNDER PIPEDA Under PIPEDA and applicable provincial legislation, you have the right to: • Access the personal information Stitch holds about you and receive an explanation of how it has been used • Request correction of any inaccurate, incomplete, or outdated personal information • Withdraw consent to our processing of your personal information, subject to legal limitations • File a complaint with the Office of the Privacy Commissioner of Canada (OPC) if you believe we have violated your privacy rights under PIPEDA QUEBEC RESIDENTS If you are located in Quebec, you have additional rights under Law 25, including the right to data portability (to receive your personal data in a structured, reusable format), and the right to request an explanation of how automated decisions affecting you are made. To exercise these rights, contact support@stitchmessaging.com. Any disputes between Canadian users and Stitch that cannot be resolved informally shall be governed by and resolved in accordance with applicable Canadian federal and provincial law.

17. European Users (EU, EEA & UK)

If you are located in the European Union, the European Economic Area (EEA), or the United Kingdom (UK), the following provisions apply. Where they conflict with other provisions of these Terms, these regional provisions take precedence to the extent required by applicable law. LEGAL BASIS FOR PROCESSING Under the General Data Protection Regulation (GDPR) and the UK GDPR, Stitch processes your personal data on the following lawful bases: • Performance of Contract: Processing your account information, messages, and related data is necessary to deliver the Stitch service you have agreed to use. • Legitimate Interests: We process limited technical and usage data to detect abuse, maintain platform security, and improve the service, provided that our interests do not override your fundamental rights and freedoms. • Consent: Where required by applicable law, we will seek your explicit and informed consent before processing. You may withdraw consent at any time without affecting the lawfulness of processing that occurred before withdrawal. YOUR GDPR RIGHTS You have the following rights under GDPR and UK GDPR, which you may exercise by contacting us at support@stitchmessaging.com: • Right of Access: Request a copy of all personal data we hold about you and information about how it is processed. • Right to Rectification: Request correction of inaccurate or incomplete personal data without undue delay. • Right to Erasure ("Right to be Forgotten"): Request deletion of your personal data where there is no longer a legitimate legal basis for us to retain it. • Right to Restrict Processing: Request that we temporarily pause processing of your personal data while a dispute is resolved. • Right to Data Portability: Receive personal data you have provided to us in a structured, commonly used, machine-readable format. • Right to Object: Object to processing of your personal data based on legitimate interests or for direct marketing purposes. • Rights Related to Automated Decision-Making: Not be subject to decisions based solely on automated processing, including profiling, that produce significant legal or similarly significant effects on you. We will respond to all rights requests within 30 days of receipt. In complex cases, we may extend this period by up to two additional months, notifying you of the extension and the reason. DATA TRANSFERS Stitch operates globally. Your personal data may be transferred to and stored in countries outside the EU, EEA, or UK that may not provide an equivalent level of data protection. Where such transfers occur, we ensure appropriate and lawful safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission or the UK Information Commissioner's Office, as applicable. COMPLAINTS If you are not satisfied with how we have handled your personal data or any rights request, you have the right to lodge a complaint with your national data protection supervisory authority. In the UK, this is the Information Commissioner's Office (ICO). In the EU, this is the supervisory authority in your country of residence or establishment. DATA CONTROLLER For users in the EU, EEA, and UK, Stitch Messaging acts as the data controller responsible for your personal information. Our primary contact for data protection matters is support@stitchmessaging.com. MINIMUM AGE The minimum age to use Stitch in the EU varies by member state, ranging from 13 to 16 years old depending on national digital consent laws. Users under the applicable age of digital consent in their country of residence may not use Stitch without verifiable parental or guardian consent.

18. Governing Law & Disputes

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which Stitch Messaging operates, without regard to conflict of law provisions that would require the application of the law of a different jurisdiction. Any dispute arising from these Terms or your use of Stitch that cannot be resolved informally should first be submitted to us in writing at support@stitchmessaging.com, clearly describing the nature of the dispute and the resolution you are seeking. We commit to making a genuine and good-faith effort to resolve any such dispute within 30 days of receiving written notice. If informal resolution is unsuccessful, both parties agree to submit to the exclusive jurisdiction of the competent courts in the applicable jurisdiction for resolution of the dispute, except where arbitration is required under Section 15 (United States Users) or where other regional provisions specify alternative dispute mechanisms.

We aim to respond to all general inquiries within 3 business days. Legal or formal notices may take longer to process. For privacy-specific requests (data access, deletion, corrections), please use the subject line "Privacy Request" so we can route your inquiry to the appropriate team.
